The High Court in Oji River today dismissed the suit filed by Bede Chukwuekezie
against APGA and INEC as the second defendant on the choice of Chief Hon.
Emma Nwankpa as the party’s Governorship candidate in the forthcoming general
election. The Court presided by Justice C. Ajah in his ruling, stated that the suit did
not comply with the constitutional provision which says that any suit arising from
the conduct of any primary election should be filed within fourteen days after the
primary but in this case the plaintif Bede Chukwuekezie filed thirty one days after
the primary meaning that the suit was incompetent.
The defense counsel Barrister
Venatus Odo who addressed the press after the judgement said that the court saw
the emptiness of the suit as the party duely issued a certificate of Return to chief
Hon Emma Nwankpa as the party’s candidate. The suit he further noted lacks any merit hence it was struck out.
